He also said he did not appeared before police for statement but he did not asked police that summons where issued or not? He failed to address the Lalita kumari guidelines that it is the duty of police to conduct preliminary enquiry in 15 days time limit. He deliberately overlooked basic lalita kumari guidelines which was the base of complaint. As per court first complainant has to do research then only he can do complaint.
The police and mining Mafia racket is well known in Madhya Pradesh. No body wants to attack on this racket. So court may be in pressure to avoid investigation so ignored many ruling ie Delhi NCT VS Sanjay kumar where FIR is mandatory in illegal mining.
At any case No body is following Supreme court constitution bench Lalita Kumari guidelines which is binding on lower courts. So they did not give reference of that in order to avoid contempt.
