Why Indore Magistrate Protecting Criminals From Investigation?

 






Indore : In a Fire Incidence at Medanta Hospital Indore Magistrate Ravendra Kumar Soni asking complainant to approach High Court for FIR registration or File PIL for that. When a complaint under CRPC 156(3) filed for FIR registration against director and SHO vijay Nagar then Magistrate asked complainant about the locus of complainant. How you are affected ? Is your family members affected? He said I will not entertain this complaint as you are not affected. Complainant Sanjay Mishra argued that anybody can file FIR in cognizable offence but he did not satisfied.

Lack of knowledge that in criminal any body can set criminal law into its motion of Magistrate Ravendra Kumar Soni is effecting quality of orders. The Magistrate May reject CRPC 156 complaint but cannot do arbitrarily . He has to reject as per the procedure of rule of law set by apex court. Supreme Court says that in cognizable offence magistrate has mandatory duty to pass order of  investigation. In Past the JMFC Ravendra Kumar Soni rejected a CRPC 156 (3) complaint by quoting reason that complainant has not exhausted CRPC 154(3) provision ie. complaint to SP. The complainant Sanjay Mishra said that he has enclosed SP copy in the petition but magistrate has done fraud by passing order by suppression of facts. Ravindra kumar Soni is also not entertaining VC request for arguments. He is allocating 2 months date in CRPC 156 complaint in which time limit is 15 days . He is aware of HC time limit order but he delibrately and wilfully disobey such order. 

The practice of Magistrate to suppress Documents in order and not obeying Superior courts order is routine as Supreme court registry is protecting judicial officers from contempt. The HC Vigilance department  is also neglecting complaints of judicial misconduct . The burden of cases are increasing in HC and SC due to failure of district courts to obey order.
