SC: जबलपुर के Session judge और Magistrate पर Contempt Case दायर

सुप्रीम कोर्ट ललिता कुमारी आदेश नहीं माना और FIR करने का पुलिस को निर्देश नही दिया। COMPLAINANT को कहा की FIR के लिए हाई कोर्ट या सुप्रीम कोर्ट जाओ।

Jabalpur: Civil Contempt Petition is filed at Supreme Court against Shri Umesh Kumar Soni , Session Judge and Smt Preeti Shikha Agnihotri JMFC for doing contempt of Lalita Kumari Constitution bench order. The complainant Sapan Shrivastava filed CRPC 156 complaint before JMFC Preeti Shikha Agnihotri that Sudha hospital has taken hospital license with compliance of Fire NOC . He prayed to register FIR against Sudha Choubey and other CMHO officials under IPC 336,420,218,166A etc which are cognizable offence. As per Lalita Kumari Constitution bench order FIR is mandatory in cognizable offence. Magistrate has power to take contempt action if police do not register FIR in cognizable offence within 15 days as per para 3 of Lalita Kumari order.

The JMFC Preeti Shikha Agnihotri directed complainant to approach High court and supreme court under article 226 & 32 to register FIR. She denied to set criminal law into its motions as per apex court order. In recall she again denied to direct police to register FIR and made wilfully and deliberately contempt of supreme court order to favour rich people from investigation.

Later Session judge Umesh Kumar Soni also denied to correct the order of JMFC and allowed contempt of SC order as a custodian of constitution at Jabalpur.

Sufficient evidence was annexed in complaint of crime . The session judge was informed that Ujjain police has registered FIR against Patidar hospital for operating without fire NOC. Then also he suppressed the fact in order and denied FIR in cognizable offence.

The JMFC Preeti Shikha Agnihotri is now promoted and posted at Rewa court.Matter soon will be listed after vacation at supreme court .
