Jabalpur Magistrate Denied To Register FIR In Cognizable Offence , JMFC Preeti Shikha Agnihotri Directed To Go High Court Or Supreme Court For FIR.....

JMFC JABALPUR DONE CONTEMPT OF SUPREME COURT LALITHA KUMARI GUIDELINES TO SAVE CORRUPT PUBLIC SERVANTS

Jabalpur MP: A criminal complaint was filed before JMFC under CRPC 156(3) to direct police to register FIR in cognizable offence by a hospital owner and medical officers of MP Health Department. In Past a hospital was registered by health department without doing all the compliance ie Fire NOC which is mandatory under law. The FIR was demanded as per Lalitha kumari guidelines as police denied to register FIR under IPC 166A,218,420,336,109,34 etc .

The JMFC said that complainant has to approach High court and Supreme court for justice. Smt Preeti Shikha Agnihotri JMFC Jabalpur denied to direct police to register offence under CRPC 154(1) in cognizable offence. She deliberately neglected the Lalitha Kumari guidelines which was mentioned in petition. As law does not give any immunity for investigation so it was her duty to direct investigation in cognizable offence. But to safe guard the interest of public servants she deliberately and willfully done contempt of Supreme order.

It has been observed that lower courts are passing adverse order against the settled law. JMFC has directed to use other remedy before high court and supreme court . She was not ready to pass order under CRPC 156 which was mentioned in prayer. The Judge should not give advise to litigants and they have to pass order according to law . In order to direct investigation JMFC has taken different stand against supreme court order and challenged the authority in Jabalpur region. It has been seen that other magistrates are directing police report before passing order but in this case JMFC Agnihotri has rejected petition against rule of law. In past kerla high Court Judge Sumotoo withdraw his order as it was against supreme court direction .

Due to non compliance many patients are dying in hospital due to fire incidents. The white collor crime should not be neglected.
