MUMBAI 64TH MM COURT MAGISTRATE DIRECTED COMPLAINANT TO FILE PHYSICAL COMPLAINT TO POLICE IN CRPC 156(3) MATTER
Mumbai: Mumbai Esplanda Court Magistrate Shri HU Joshi said that the complaint sent via email or by Aapla Sarkar is not valid as per CRPC 154(1) AND (3). As per Lalita Kumari order complaint should be sent in physical form with acknowledge copy. When a party in person went to file 2 matters for FIR registration in Azad maidan police station jurisdiction then court commented these lines to complainant. The court said that you should wait 1 month and then approach to court. When complainant said that at many courts of Mumbai and Thane he has enclosed the email correspondence and courts did not taken any objections. He also said that the email communication is valid as per evidence act and there is no time limit to approach court after compliance.
When complainant denied to withdraw complaint then court sent copies to filing department and given January date for argument.
It's legal to send mail as per Section 4 of the INFORMATION AND TECHNOLOGY ACT.
