SC Rejected Bail As Petitioner Disobeys Verbal Order To Vacate The Flat

Delhi: Supreme court rejected the Anticipatory Bail of petitioner as he denied to obey Justice Ajay Rastogi and Justice CT Ravikumar verbal order . The complainant filed FIR against the petitioner for doing forge signature in MOU for rented home. He submitted zerox copy of MOU to Mumbra police in March 2019 and FIR was registered under IPC 420,467 etc.

Bombay High court rejected ABA as petitioner was not ready to vacate flat to get ABA. Police already given CRPC 41A notice in 2019. Petitioner was attending police station as per IO investigation. Since last 3 years police also failed to get handwriting expert report. As per the petitioner the copy of MOU is not available at any record of court with FIR.

Since last 3 hearings supreme court was asking petitioner to vacate the flat. Petitioner said that civil case is pending at Thane court to vacate the flat and complainant has failed to produce ownership documents till date at civil court. The PP and court verbally insisting petitioner to vacate the flat located at Diva. However Court did not passed written instructions to vacate the flat. When petitioner said that flat dispute is pending at civil court then justice Rastogi said that we will see the civil court , you say that when you are vacating the flat? When petitioner denied to vacate the flat then court dismissed the ABA and directed him to surrender inspite of CrPC 41 A notice. Court also not heard the perjury IA and disposed the SLP criminal 6909/2021.

Still the IA for perjury is pending and SLP dismissed. As per law, perjury to be decided first. As per many SC ruling civil disputes should not be converted into criminal to put pressure. High court should quash such FIR . But here the criminal court is doing the job of civil court by arms twisting to get freedom.

In financial scam Is court asking to deposit money to get ABA? Court should ask police that why Chargesheet is not filed after 3 years? Why court did not passed written order to vacate the flat? Complainant did not appointed any councel inspite of notice sent by court. Petitioner will soon surrender before police as per court direction.
