Dewas: BNP थाना प्रभारी E FIR अपनी मर्जी से टेक्निकल कारण बता कर अस्वीकार कर रहे है। एफआईआर ONLINE या ऑफलाइन हो इसको रद्द करने का POWER HIGH COURT के पास CRPC ४८२ में है। जिला जज भी इसको QUASH नही कर सकते। थाना प्रभारी मुकेश इजारदार कुर्सी मे बैठ कर FIR QUASHING कर रहे है क्योंकि एफआईआर अंग्रजी में लिखी थी। तकनीक कारण बता कर E FIR बंद कर दी। E FIR की रिपोर्ट सीआरपीसी १७३ मैं कोर्ट मे देना अनिवार्य है पर वो कोर्ट से भी ऊपर है। बिना jurisdiction थाने मे कोर्ट का काम हो रहा है। जब उनके शुभ चिंतको के खिलाफ एफआइआर आती है तो पैसा लेकर जज बन जाते है और QUASH कर देते है। इनको नौकरी की चिंता नहीं है। अन्य जिलों की पुलिस E FIR में जांच कर रिपोर्ट कोर्ट में पेश कर रही है पर देवास पुलिस जज बन गई है।अगर कोई CRPC 156 में केस डाल दे तो रिपोर्ट झक मारके जमा करनी पड़ेगी। कोई अधिकारी बिना INVESTIGATION FIR नही बंद कर सकता। लोगो को पता नहीं की E एफआईआर भी उतनी ही ताकतवर है जितनी थाने वाली होती है।

12. Having heard learned counsel for the parties, we think it appropriate to record the requisite conclusions and, thereafter, proceed to issue the directions:-

(a) An accused is entitled to get a copy of the First Information Report at an earlier stage than as prescribed under Section 207 of the Cr.P.C.

(b) An accused who has reasons to suspect that he has been roped in a criminal case and his name may be finding place in a First Information Report can submit an application through his representative/agent/parokar for grant of a certified copy before the concerned police officer or to the Superintendent of Police on payment of such fee which is payable for obtaining such a copy from the Court. On such application being made, the copy shall be supplied within twenty-four hours.

(c) Once the First Information Report is forwarded by the police station to the concerned Magistrate or any Special Judge, on an application being filed for certified copy on behalf of the accused, the same shall be given by the Court concerned within two working days.

The aforesaid direction has nothing to do with the statutory mandate inhered under Section 207 of the Cr.P.C.
