UMARIA SESSION GIVEN CLEAN HIT TO ACCUSED WITHOUT FIR IN COGNIZABLE OFFENCE. CONDUCTED TRIAL WITHOUT POLICE REPORT AND RULE OF LAW

Judge said that in photo graphs reverse flag is not visible and he also not heard complainant . It is violation of principle of natural justice . Judge Said that he Know SC Lalita Kumari Judgement but he did not acted accordingly. Lalita Kumari did not allow judge to conduct trial in any allegation. It says that judge has to see that cognizable offence is made out or not. As both the offence are cognizable so he must direct police to register FIR and after report only Judge can give clean chit by hearing complainant. Without Police FIR and report judge cannot give clean chit to accused . Judge has conducted trial in pre cognizable stage to protect well wisher. As collector hold monthly meeting with judges in district court and he assist few judges on personal request so Judge Ahamed Raza also obliged him against rule of law.
CASE LAW....
MAGISTRATE OR POLICE CANNOT CHECK GENUINENESS OF INFORMATION BEFORE REGISTRATION OF FIR.
1. SC:Registration of FIR is mandatory if information given to police discloses commission of cognizable offence - At that stage other considerations such as genuineness or credibility of information not relevant - S. 154 Cr.P.C.
Registration of FIR is mandatory if the information given to the police under Section 154 of the Code discloses the commission of a cognizable offence. However, if no cognizable offence is be made out in the information given, then the FIR need not be registered immediately and perhaps the police can conduct a sort of preliminary verification or inquiry for the limited purpose of ascertaining as to whether a cognizable offence has been committed. But, if the information given clearly mentions the commission of a cognizable offence, there is no other option but to register an FIR forthwith. Other considerations are not not relevant at the stage of registration is falsely given, whether the information is genuine, whether the information is credible, etc. At the stage of registration of FIR, what is to be seen is merely whether the information given ex facie discloses the commission of a cognizable offence. (Paras 6 and 8).
Case: State of Telangana Vs. Habib Abdullah Jeelani
Citation:(2017) 2 SCC 779 : (2017) 2 SCC (Cri) 142 : AIR 2017 SC 373.
Learned Public Prosecutor for the State has submitted that reasonableness and credibility of information is not a condition precedent for registration of a case by police. The only condition which is sine qua non for recording an FIR is that there must be an information and that information must disclose a cognizable offence. Learned Public Prosecutor for the State further submits that the information received is genuine or not, can only be considered after a registration of the case. The Apex Court in the case of Ramesh Kumari vs. State (NCT of Delhi), 2006 (1) Crimes 229 S.C. is a relevant case to that effect. Further in P.K. Lallan Choudhary vs. State of Bihar & Anr., 2006 (SAR) Criminal 934 wherein, it has been also held that in state of registration of FIR, Police Officer concerned cannot embark upon as to whether the information revealed by the informant is reliable and genuine or not. It has further been stated that the Police Officer cannot refuse to register a case on the ground that the information is not relevant or credible. Thus, one can see that once an information as to the occurrence of cognizable offence has been brought to the notice of police, the Police Officer is bound to register the same as FIR and carry out his investigation. However, there is one impediment, which would surface when there is statutory prohibition for the Court to take cognizance.
In the case of State of Haryana v Bhajan Lal Air 1992 SC 604 the Supreme Court of India has held that genuineness, reliability and credibility of the information is no ground to refuse to register the information.
In the case of Surjit singh v State of Punjab AIR 1992 SC 1389. the Supreme Court said, “It is not an encyclopaedia of the entire case and it is, therefore not necessary that such information may be give by an eye-witness. It may be hearsay also”. Anyhear person may provide such information to an officer-in-charge of a police station. In the case of Kishan Chand v State of Rajasthan AIR 1982 SC 1511 the Supreme Court held that an FIR need be in writing nor against a named person, even a telephonic message if it discloses a cognizable offence may constitute first information report. In a subsequent case of State of A.P. v Punati Ravulu AIR 1993 SC 2644 the Supreme Court has said that refusal to record information is declaration of duty by the police officer.
In the case of Hem Raj v State of Punjab AIR 2003 SC 4259 the Supreme Court has said that the section 154 of CrPC. requires an information of a cognizable offence to set the investigation machinery into action. First Information Report may or may not contain all details and particulars as to incident. It is sufficient if it indicates commission of a crime so as to enable police to start an investigation. Elaborate account of everything what had happened is not necessary. In the case of State of U.P. v Harbans Rai (1998) 6 SCC 50 the Supreme Court said that FIR is neither Magna Carta nor encyclopaedia nor chronicle of the exhaustive details of the occurrence, nor catalogue of every minute particular of the event.
Supreme Court of India
Superintendent Of Police, C.B.I. ... vs Tapan Kr. Singh on 10 April, 2003
Similarly, the mentioning of a particular Section in the F.I.R is not by itself conclusive as it is for the Court to frame charges having regard to the material on record. Even if a wrong Section is mentioned in the F.I.R., that does not prevent the Court from framing appropriate charges.
In paragraph 20 in the case of Tapan Kumar Singh (supra), it is observed and held as under: 20. It is well settled that a first information report is not an encyclopaedia, which must disclose all facts and details relating to the offence reported. An informant may lodge a report about the commission of an offence though he may not know the name of the victim or his assailant. He may not even know how the occurrence took place. A first informant need not necessarily be an eyewitness so as to be able to disclose in great detail all aspects of the offence committed. What is of significance is that the information given must disclose the commission of a cognizable offence and the information so lodged must provide a basis for the police officer to suspect the commission of a cognizable offence. At this stage it is enough if the police officer on the basis of the information given suspects the commission of a cognizable offence, and not that he must be convinced or satisfied that a cognizable offence has been committed. If he has reasons to suspect, on the basis of information received, that a cognizable offence may have been committed, he is bound to record the information and conduct an investigation. At this stage it is also not necessary for him to satisfy himself about the truthfulness of the information. It is only after a complete investigation that he may be able to report on the truthfulness or otherwise of the information. Similarly, even if the information does not furnish all the details he must find out those details in the course of investigation and collect all the necessary evidence. The information given disclosing the commission of a cognizable offence only sets in motion the investigative machinery, with a view to collect all necessary evidence, and thereafter to take action in accordance with law. The true test is whether the information furnished provides a reason to suspect the commission of an offence, which the police officer concerned is empowered under Section 156 of the Code to investigate. If it does, he has no option but to record the information and proceed to investigate the case either himself or depute any other competent officer to conduct the investigation. The question as to whether the report is true, whether it discloses full details regarding the manner of occurrence, whether the accused is named, and whether there is sufficient evidence to support the allegations are all matters which are alien to the consideration of the question whether the report discloses the commission of a cognizable offence. Even if the information does not give full details regarding these matters, the investigating officer is not absolved of his duty to investigate the case and discover the true facts, if he can.”
IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NOS. 5267-5268 OF 2024 (Arising out of S.L.P. (Crl.) Nos. 8239-8240 of 2018) OM PRAKASH YADAV …APPELLANT(S) VERSUS NIRANJAN KUMAR UPADHYAY & ORS …RESPONDENT(S)
Testing genuineness of allegations in the application u/s. 156(3) CrPC by evidence not to be done by Magistrate--- (A) A Magistrate u/s. 156(3) CrPC is not required to go into the factum of genuineness of allegations contained in the application. If the contents of the application disclose a cognizable offence, Magistrate has to pass order for registration of FIR and investigation thereof. Assessment of evidence and drawing of inferences not required to be done u/s. 156(3) CrPC. See--- 1. Ram Pal Singh vs. State of U.P., 2007 (1) J.Cr.C. 257 (All) 2. Dr. Rajendra Prasad vs. ACJM, Lucknow, 1996 JIC 5 (All—L.B.) 3. Roop Ram vs. State of U.P., 2009 (66) ACC 870 (All) .
The information received is genuine or not, can only be considered after a registration of the case.
IN THE SUPREME COURT OF INDIA CRIMINAL APPELLATE JURISDICTION CRIMINAL APPEAL NO. 1581 OF 2021 Kailash Vijayvargiya …Appellant Versus Rajlakshmi Chaudhuri and others …Respondents
8.On the other hand, it is the case on behalf of the original complainant as well as the State that as mandated by this Court in the case of Lalita Kumari (supra), at the stage of registering the FIR, neither the Magistrate nor the police officer has any jurisdiction to verify the truth and veracity of the allegations and/or consider the truthfulness of the allegations. According to the respondents, what is required to be considered at that stage is, whether the allegations in the complaint/application disclose commission of any cognizable offence or not. Therefore, the main issue posed for the consideration of this Court is, whether in the facts and circumstances of the case, the learned CJM was justified in verifying the truth and veracity of the allegations at the stage of deciding the application under Section 156(3) Cr.P.C. and whether at that stage the Magistrate is required to apply judicial mind or not?
Truth of allegations in complaint not to be gone into at the stage of cognizance: At the stage of taking cognizance of offences in a complaint case, it is impermissible to go into the truthfulness or otherwise of the allegations made in the complaint and one has to proceed on a footing that the allegations made are true. See.. Gambhirsinh R.Dekare Vs. Fhalgunbhai Chimanbhai Patel, AIR 2013 SC 1590.
