उमरिया Madhya Pradesh : मजिस्ट्रेट श्री अभिषेक कुमार के ऊपर याचिकाकर्ता सपन श्रीवास्तव ने सिविल कंटेंप्ट पिटीशन दायर किया। आरोप है कि मजिस्ट्रेट बिना सुनवाई किए lockdown में विपरीत आदेश पारित कर रहे थे। 8 april 2021 के बाद जिला जज श्री अनिल भाटिया ने आदेश पारित किया की बिना सुनवाई के किसी के खिलाफ कोई adverse order नहीं पास हो पर मजिस्ट्रेट साहब 4केस बिना सुनवाई के खारिज कर दिए। जिस दिन केस फाइल किया उसी दिन बिना सुनवाई आदेश पारित कर दिया। 9 अप्रैल को 3.30बजे केस फाइल किया। शाम को 2 जून की date दी। बाद मे मालूम हुआ कि back date 9 april को ही केस बिना सुनवाई के खारिज। ऐसा 30अप्रैल और 15 may को भी किया और 4 केस बिना सुनवाई के adverse order पास किया। उनको पिटीशन मे याद दिलाया गया कि ये जिला जज के आदेश का violation है फिर भी मजिस्ट्रेट ने केस खारिज किए। मजिस्ट्रेट साहब सुप्रीम कोर्ट के settle law के खिलाफ जा कर crpc 156 के केस खारिज कर रहे थे। याचिका में affidavit file नहीं है , या पुलिस एसपी को शिकायत नहीं की ऐसा आधार बना रहे थे । पिटीशन मे सब कागज थे फिर भी आरोपी लोगो को बचाया जा रहा था। सुप्रीम कोर्ट का आदेश है कि ग़लती को ठीक करने दिया जाए ना की adverse order दिया जाए। सरकारी crime को बचाने के लिए बिना सुने adverse order pass हो रहे थे लॉकडाउन में।
बाद में magistrate की DJ OFFICE मे शिकायत की गई, पर sumotoo कोई कार्यवाही नहीं हुई। इसलिए petitioner ने सिविल कंटेंप्ट दायर किया। सुनवाई जल्दी शुरू होगी।
Civil contempt petition filed against JMFC Abhishek Kumar before district judge Umaria Shri Anil Bhatia. On 8th April 21 the DJ has passed order that no adverse order to be passed without hearing. It is settled law that violation of natural justice is against Judicial procedure. The JMFC was passing adverse order in 4 Cases of CRPC 156 matters without virtual hearing inspite of request. He deliberately and willfully ignored District judge order which is binding on him. He rejected cases for simple reasons which can be cured or not true. It is also violation of MP high court and supreme court order that Petitioner should be allowed to rectify any mistakes . He also done contempt of such superior court orders. In CRPC 156 Cases Petitioner demanded FIR against top officers and corrupt businessmen of Umaria with police officials. To save them he was rejecting cases against supreme court guidelines which is binding for him.
In past high court vigilance also initiated enquiry for Violation of judicial standard as per KK Dhawan guidelines against JMFC Abhishek Kumar.
