Sehore : Trident Ltd has huge
textile plant at Budhni, Sehore in 900 acers approx land. The huge civil work
has been done in 900 acres land by Trident Ltd in last 6 years. The Complainant
SK Shrivastava Done complaint to mining Officer sehore that No Royalty has been
paid by trident so mining office conducted enquiry. The company failed to show
all TP and Bills of minor minerals used in civil works. It means they
have done illegal mining and transportation of millions of cubic meters minor
minerals from near by river belt .Illegal mining and transportation is offence
under IPC 379,413 etc as per supreme court order in Sanjay Kumar (Supra).
E FIR is registered against
Directors of company Officials. RAJINDER GUPTA , PK MARKANDAY , DEEPAK NANDA and unknown persons under IPC 379,413,420,120B,34,section 21 of
MMDR etc and also against unknown accused. Investigation of Mining officers MA Khan ,
SHO VIKAS KINCHI Budhni Police
Inspector under IPC 166A(b),218,109,34,409 etc for showing disrespect and disobey
to Hon’ble HC and SC orders of Lalita Kumari which is binding for them.
The complainant
filed under CRPC 156 case for monitor of investigation as per Sakri Basu case . The
JMFC Budhni Rajesh Shrivastava CJ1 dismissed the complaint against SHO Budhni and recall petition by
saying that he don't believe in E FIR as CRPC 154 document. He believe in E
Ticket , E Filing , E Payment but not in E FIR to favour accuse . He passed Whimsical
order to protect accuse well wisher personal of huge face value.
In Criminal
revision the Session Judge Shri Manoj Kumar Lowanshi passed order related to Registration Of FIR not for monitoring investigation. The petition was filed to monitor the
investigation as FIR is already registered but he passed order for registration of FIR (SAPAN VS SHO BUDHNI ) . It is like this in ramayana he is narrating story of Mahabharat. Orders
copies are available in court portal. The Budhni Police and court officials are
highly obliged and bias to secure criminal act. The Session Judge Manoj Kumar
Lowanshi is facing contempt action at Supreme Court for disobeying Lalita
Kumari guidelines. In Trident Fire incidence CRPC 156/397 matter he permitted
police to do preliminary enquiry for more than 1 year. The time limit set by
SC is 15 days to 6 week Maximum.
Without paying
the penalty of 35-70 times including basic cost +royalty the section 21 of MMDR accused will not get relaxed. After paying penalty trial of IPC will continue as per SC
Jayant Kumar order. E FIR can only be quashed by High Court under CRPC 482 ,
but SHO misguiding accused that E FIR is quashed by police. Already Criminal
case against Trident management is pending before MP High Court for FIR
registration of fire incidence in April 2021.
